1.2 These Terms (as defined below) set out the essential terms and conditions that govern:
(i) our relationship with you and clearly define and document our rights, responsibilities, and obligations; (ii) your access to and use of the Platform and the Services (as defined below) provided by Qore Academy; and (iii) the actions, transactions, communications, and activities undertaken by you through the Platform or pursuant to the Services. These Terms are incorporated into and form part of the contract between you and us, including when you register yourself with us.
2.1 These Terms constitute an electronic record within the meaning of Applicable Law (as defined below) and do not require any physical or digital signatures. These Terms are published in compliance with, and are governed by, the provisions of Indian law, including but not limited to:
(i) the Indian Contract Act, 1872; and (ii) the (Indian) Information Technology Act, 2000 and the rules, regulations, guidelines and clarifications framed thereunder.
2.2 Please read these Terms carefully before using the Platform and the Services or registering for an Account. These Terms apply to all Users of the Platform and the Services, irrespective of the mode and the manner in which they have accessed the Platform and the Services. Please also read the Privacy Policy before you use the Platform and the Services. If you do not understand or do not wish to be bound by the terms of these Terms, you should not use the Platform and the Services.
2.3 The Platform is for adults or people who have attained the age of majority. Subject to these Terms, use of the Platform and the Services is available only to Persons who can enter into legally binding contracts under Applicable Law. By using the Platform or the Services, you represent and warrant that you are 18 (Eighteen) years of age or older and competent to enter into a contract.
2.4 You are solely responsible for ensuring that these Terms are in compliance with all Laws applicable to you, and the right to access the Platform and the Services is revoked where the Platform or the Services is prohibited.
2.5 The Platform is hosted, operated, and controlled by Qore Academy in India, and the Content provided on or accessible through the Platform is not directed to any jurisdiction where such distribution or use would be contrary to Law. Accessing the Platform from territories where the Platform or any Content is illegal is expressly prohibited.
2.6 If you are using the Services on behalf of an entity, company, or other organization/association, you represent and warrant that you: (i) have the authority to bind such entity to these Terms; and (ii) agree to be bound by these Terms on behalf of such entity.
2.7 Visiting, browsing, accessing, or using the Platform and/or the Services constitutes your unconditional acceptance and agreement to be legally bound by these Terms.
2.8 Qore Academy reserves the right, at any time and from time to time, to amend, modify, revise, update, suspend, remove and/or otherwise change these Terms without prior notice to you. All such amendments and modifications shall take effect immediately when posted on the Platform.
3.1 Definitions
In these Terms, the following words and expressions shall bear the meanings assigned to them below:
– “Applicable Laws” or “Laws” means all applicable laws, statutes, enactments, acts of legislature or parliament, ordinances, judgments, decrees, injunctions, writs, rules, by-laws, regulations, notifications, circulars, guidelines, policies, directions, directives, demands conventions, orders, interpretations, licenses and/or permits of all Governmental Authorities of all relevant jurisdictions.
– “Content” includes all data, information, and material of whatsoever nature, in digital form or otherwise, including writings, texts, comments, presentations, reports, images, videos, software, product portfolios, and drawing and design files.
– “Course(s)” means the educational services offered by Qore Academy through the Platform, specifically tailored for the Architecture, Engineering, and Construction (AEC) industry.
– “Course Content” includes the components and contents of a Course, including syllabus, curriculum, descriptions, and intended learning outcomes.
– “Course Materials” includes all works of authorship, educational software, digital files, BIM models, and documentation used in connection with the Courses.
– “Data Protection Laws” means any privacy and/or data protection Laws that apply to the processing of Personal Data, including the Digital Personal Data Protection Act, 2023 (India) and the GDPR, where applicable.
– “Force Majeure” means any event beyond the reasonable control of Qore Academy, including natural disasters, internet failures, malicious cyber-attacks, or government restrictions.
– “Hiring Partner” means a Person partnering with Qore Academy to hire Candidates who have completed Courses on the Platform.
– “Mentor” includes an instructor, teacher, guide, or counselor who designs, develops, or delivers the Courses through the Platform.
– “Qore Academy” refers to the entity operating the Platform, its subsidiaries, affiliates, associate companies, and other group companies.
– “Qore Academy Content” means Content created and developed by Qore Academy and its licensors and published on the Platform.
– “Qore Academy Marks” means the trademarks, service marks, trade names, domain names, and logos owned by Qore Academy.
– “Qore Academy Technology” includes the algorithms, software, Learning Management Systems (LMS), video hosting infrastructures, and interfaces used by Qore Academy to provide the Platform.
– “Platform” means Qore Academy’s online platform https://www.qoreacademy.com/ and all related domains and applications.
– “Services” means the Courses, features, and tools offered by Qore Academy through the Platform.
– “Subscriber” means a Person who has purchased or subscribed to a Course through the Platform.
– “User” includes any Person visiting, browsing, accessing, and/or using the Platform, including a Subscriber.
3.2 Interpretation
– The terms “we”, “our” and “us” refer to Qore Academy.
– The terms “you” or “your” refers to a User.
– Words denoting the singular shall include the plural and vice versa.
4.1 When you access or use the Platform, you agree and understand that you are communicating with us through electronic records, and you consent to receive communications via electronic records (including SMS and email) from us periodically.
4.2 You understand that as part of your registration process, you may receive SMS messages from Qore Academy on your registered mobile number for authentication, transactional updates, and Course notifications.
4.3 You expressly consent to electronically receive all communications, agreements, documents, notices, and disclosures.
5.1 Qore Academy is an education and technology service provider offering Courses through the Platform; it is NOT a traditional university.
5.2 The Platform is designed to deliver an educational experience to Subscribers, specifically tailored for professionals and students in the AEC industry to master skills like BIM, Scan-to-BIM, and related workflows.
5.3 When you enroll in a Course, Qore Academy grants you a limited, non-exclusive license to view and pursue the Course for your personal academic growth. This license does not give you any right to resell or redistribute the Courses, Course Content, or Course Material.
5.4 Qore Academy will generally list all its Courses on the Platform and reserves the right to add, withdraw, or modify the Courses at any time without notice.
5.5 Qore Academy offers no academic credit for its Users. Participation in or completion of a Course does not confer any university-recognized academic credit, though we may offer verified certificates of completion.
5.6 You shall not use the Platform or any Service for any purposes not intended under these Terms. Qore Academy reserves the right to restrict, suspend, or terminate your Account if you misuse the Platform.
6.1 To use the Services, you must register and create an Account on the Platform. You must provide accurate and complete information. You shall not select a username with the intent to impersonate another person or use offensive language.
6.2 You are solely responsible for maintaining the confidentiality of your username and password. Qore Academy shall not be liable for any Loss as a result of your failure to keep your Account secure.
7.1 Subject to these Terms, we grant each User a non-exclusive, revocable, non-transferable, and limited license to access and use the Platform.
7.2 A User shall not: (i) copy, adapt, or reverse engineer the Platform; (ii) remove proprietary markings; or (iii) use the Qore Academy Technology to create a competing platform.
7.3 When you upload your Content onto the Platform, you automatically grant Qore Academy a non-exclusive license to use your Content for the purposes of providing the Services.
8.1 Membership: Opening an Account and browsing the Platform is free.
8.2 Course Fee: The prices of the Courses are determined by Qore Academy and are subject to change.
8.3 Taxes: You agree to pay the applicable Course fee along with all applicable taxes and levies. 8.4 Payment Methods: Payments may be made through electronic Payment Gateways hosted on the Platform. Qore Academy does not collect or store full credit card/banking details and assumes no liability for errors made by the Payment Gateway Service Provider.
8.5 Refunds: Any payments made by a Subscriber are non-refundable except as explicitly provided in the specific cancellation policy of the Course you have subscribed to.
9.1 Subscribers Account: You agree not to share your Account, cheat on assignments, or share solutions.
9.2 No Academic Credit or Employment Guarantee: While we strive to provide industry-leading AEC education, Qore Academy does not guarantee employment, salary hikes, or specific professional outcomes upon completion of a Course.
9.3 Cohort-Based Learning: Qore Academy reserves the right to determine the schedules for cohort-based programs, modify Course weights, or change Mentors.
9.4 Placement Assistance: Qore Academy may provide placement assistance to eligible Subscribers through our Hiring Partners. This is a discretionary service and cannot be claimed as a fundamental right.
9.5 Code of Conduct: Subscribers must act professionally. Aggressive, bullying, or harassing behavior toward Mentors, staff, or other Subscribers will result in immediate termination without a refund.
10.1 Access to Talent Pool: Qore Academy grants Hiring Partners access to a Candidates Directory to identify potential candidates for AEC roles.
10.2 Hiring Partner’s Obligations: The Hiring Partner is solely responsible for carrying out pre-employment screening, interviews, and background checks. Qore Academy makes no representations regarding the performance or suitability of any Candidate.
10.3 Confidentiality: Hiring Partners must treat all Candidate Information as strictly confidential and comply with all applicable Data Protection Laws.
11.1 You are solely responsible for the User Content you upload or post on the Platform. You represent that you have the necessary rights and licenses to share such Content.
11.2 By submitting User Content, you grant Qore Academy a worldwide, royalty-free, sub-licensable license to use, reproduce, and display the Content in connection with operating the Platform.
12.1 You promise not to use the Platform to upload or share Content that is unlawful, defamatory, deceptive, infringes on intellectual property rights, contains viruses or malware, or threatens the security of the Platform or any nation.
12.2 You shall not scrape, crawl, reverse engineer, or attempt to gain unauthorized access to the Platform’s underlying infrastructure or video hosting servers.
We view the protection of your privacy as a very important principle. Our collection and use of personal data are governed strictly by our Privacy Policy.
14.1 The Qore Academy Technology, the Platform, the Courses, and all related intellectual property are the exclusive property of Qore Academy.
14.2 You agree not to engage in the use, copying, downloading (unless explicitly permitted), or distribution of any Course Content for commercial purposes.
15.1 The Platform, Services, and Content are provided on an “as is” and “as available” basis, without warranty of any kind.
15.2 In no event shall Qore Academy be liable for any indirect, incidental, punitive, or consequential damages. Qore Academy’s total liability for any direct damages shall not exceed the fees paid to us by you for the specific Service in question.
If you believe that your work has been improperly copied and posted on the Platform in violation of copyright laws, please send a written complaint with necessary identification and ownership details to privacy@qoreacademy.com.
17.1 These Terms will be governed by the laws of India.
17.2 Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Mumbai, Maharashtra, India.
17.3 Disputes shall be settled in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The venue and seat of the arbitration shall be Mumbai, India, and the language of arbitration shall be English.
18.1 You may stop using the Platform at any time by writing to us at support@qoreacademy.com.
18.2 We reserve the right to terminate your access to the Platform immediately if you breach these Terms, fail to pay required fees, or engage in abusive conduct.
19.1 Force Majeure: Qore Academy shall not be liable for any failure to perform its obligations due to events beyond its reasonable control. 19.2 Severability: If any provision of these Terms is held to be invalid, the remaining provisions shall remain in full force and effect. 19.3 Assignment: You may not assign these Terms. We may assign our rights and obligations without your consent.
